The Hinckley Company (“Hinckley”, “we”, “our”, or “us”) is committed to ensuring that your privacy is protected.  We thank you for your interest and hope you find our websites, new yachts, brokerage services, YachtCare Centers and yacht services offerings (collectively, the “Services”) enjoyable and useful.  This Privacy Policy (“Privacy Policy”) outlines how we collect, use, and transfer information provided to us by consumers when you use our Services at http://www.hinckleyyachts.com, http://www.huntyachts.com, http://www.morrisyachts.com and http://www.hinckleysportboats.com, provide us information when visiting our yachts at boat shows or events (“Events”), or engage our sales, service and production teams on a new or existing boat.  We have adopted this Privacy Policy to help our customers and potential customers to understand what Data we collect, store, share, and use, how and why we do so, and what your rights are in regards to that Data.

This Privacy Policy applies to everybody who interacts with us online or otherwise.  We use the word “Data” to describe all the information we collect that relates to you and your use of our Services.  Many jurisdictions require that we disclose to you the lawful basis for our processing of your Data. We do this in the following section and throughout this Privacy Policy.  In general, our lawful basis for processing your Data is based on your specific consent or your contract with us and our legitimate interest in improving our Services based on the Data we receive from you.

  1. Information Collected and Uses

Upon visiting our websites, you will not be required to login to see all of the information about our Services.  There is no need to provide us with personally identifiable information (“Personal Information”) to view our websites, however you may choose to provide us Personal Information directly by submitting a form so that we may contact you (“Connect”) if you would like a sales representative to do so.  The information on a Connect form includes your name, address, email address, phone contact number, boating state, and the model of yacht or type of yacht service you may be interested in.  If you do not submit a Connect form, the only information we collect on our websites will be in the form of cookies and web beacons from Salesforce Marketing Cloud software which powers our websites, Google Tag Manager for use in website analytics, and TrustArc for privacy & consent management.  This includes standard information from your web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, the actions you take on our websites such as the pages viewed and the links clicked, the timing of information you post to our website, and the messages you send or receive via the Services and interactions with our team. 

Consumers who submit a Connect form will have their cookie and web beacon information matched to the Personal Information submitted.  We use this Personal Information to manage how and when we contact you as well as your preferred means of communication, prior inquiry history, website page views, and boat purchase information from our sales records.  This Personal Information also allows us to respond to your questions and social media communication as well as provide you with more information on our yachts, yacht services, and our Company overall. 

We do not sell any Data that is collected.

2. Yachts and Yacht Servicers Customers

If you purchase a new or brokerage yacht from us, use one of our YachtCare Centers for Services, or attend one of our Events we will collect and record Personal Information on your Services preferences so that we can improve our Services to you and deliver upon our contract to you.  We will use the ordering and billing information provided to us in order to bill you for Services, and we will keep records of your yacht’s systems identification numbers to improve our Services to you.

3. Disclosure of your Information

By providing Personal Information to The Hinckley Company you agree that we may share certain categories of information we collect from you in ways described in this Privacy Policy.  We share Personal Information and Traffic Data with our business partners who assist us in providing the Services via website hosting, data storage, sales opportunity management, security, advertising and promotional services.  We require those business partners to abide by our Privacy Policies or to have Privacy Policies substantially in harmony with our own.  The Hinckley Company does not share, sell, rent or trade your Personal Information with any third parties for their promotional purposes.  However, we may use your Personal Information with third-party advertising platforms to serve you with our targeted advertisements based on your personal or profile information.

We reserve the right to disclose your Personal Information as required by law or to comply with a judicial proceeding, court order, or to enforce this Privacy Policy. 

4. International Transfers of Information

The Hinckley Company is a United States-based limited liability partnership that uses Salesforce Marketing Cloud for storage of our business data.  Salesforce has certified certain services, for which they act as a data processor, under the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework.  More detail can be found here.

5. Security Information

The Hinckley Company endeavors to protect your Personal Information within our organization from loss, misuse, unauthorized access, disclosure, alteration or destruction but cannot ensure and does not warrant the security of the information you transmit to us.  We take commercially reasonable efforts to store and maintain your Data in a secure environment.  Please contact us at the address and contact info below (“Contact Information” section) if you have reason to believe that your account has been compromised

6. Privacy for EU Residents

The General Data Protection Regulation made effective in the European Union (“EU”) on May 25, 2018 (“GDPR”) requires that we clearly describe to data subjects the Data we collect and how we use that Data.   This Privacy Policy does that and we hope that if you have any questions for us regarding our data collection that you will write to us at privacy@hinckleyyachts.com or the mailing address listed in Section 9.  EU residents have the right to obtain our confirmation of whether we maintain personal information relating to them in the United States.  We will provide to EU residents Data we hold about you and you may also correct, amend or delete the Data we have about you, subject to our rights and obligations under GDPR.

7. Privacy for California Residents

California has adopted the California Consumer Privacy Act (“CCPA”) effective January 1, 2020.  We comply with the requirements of the CCPA to the extent they apply to Hinckley, if at all.  If you are a California resident and Hinckley qualifies as a “business” under the terms of that law, you have rights related to requesting the data we hold about you during the 12 months prior to your request.  You also have the right to have the Data we collect about you deleted.  To make any request under CCPA please write us at: privacy@hinckleyyachts.com or the mailing address listed in Section

8. How You Can Access, Change or Suppress Your Personal Data

If you would like to review, correct, update, suppress, delete or otherwise limit our use of your Personal Information that has been provided to us you may contact us at the address and contact info below (“Contact Information” section).
